1. Introduction
Welcome to Solar Rose Elopements ("Solar Rose Elopements," "I," "my," or "me"). By accessing and using my website (https://www.solarroseco.com) and/or engaging my elopement photography services, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully.

If you do not agree with any part of these terms, please do not use my website or services.

2. Service Description
I provide elopement photography services as described on my website. My services include capturing professional photographs of elopements and delivering edited images to clients according to the specific package selected and detailed in our contract.

3. Booking Process

3.1 Inquiries and Availability
Inquiries about my services can be made through the contact form on my website. I will respond to confirm my availability for your requested date and location.

3.2 Retainer and Booking
To secure my services for your elopement date, a non-refundable retainer is required along with a signed contract. Your booking is not confirmed until both the retainer payment has been received and the contract has been signed by all parties.

3.3 Final Payment
The remaining balance is due according to the payment schedule outlined in your contract. Failure to make payments by the agreed-upon dates may result in cancellation of services.

4. Cancellation and Rescheduling Policies

4.1 Cancellation Policy
If you cancel this contract more than 30 days before the elopement date, I will keep the retainer, and you are responsible for compensating me for any already incurred travel fees beyond the retainer fee, but you shall not be responsible for the remaining balance due.

Cancellation must be made in writing, signed by the contracted party, and sent via email or mail. If you fail to supply written cancellation as specified before the elopement date or cancel within 30 days of the elopement date, you shall be required to pay the full balance due.

4.2 Rescheduling Policy
In the event you change (1) the elopement location and/or area after signing the Agreement or (2) reschedule the elopement date agreed to at the time of signing the Agreement (without prior discussion), you forfeit the retainer. You further understand and agree that you will have to re-book and re-contract my services.

4.3 Force Majeure
No party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations to make payments to the other party hereunder), when and to the extent such failure or delay is caused by or results from acts beyond the impacted party's ("Impacted Party") control, including, but not limited to, the following force majeure events ("Force Majeure Events"):

(a) acts of God;
(b) a natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms, explosions, infestations), outbreak, or epidemic;
(c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest;
(d) government order or law;
(e) actions, embargoes or blockades in effect on or after the date of this Agreement;
(f) action by any governmental authority;
(g) national or regional emergency;
(h) strikes, labor stoppages or slowdowns or other industrial disturbances; and
(i) shortage of adequate power or transportation facilities.

The Impacted Party shall give Notice within 7 days of the Force Majeure Event to the other party, stating the period of time the occurrence is expected to continue. The Impacted Party shall use diligent efforts to end the failure or delay and ensure the effects of such Force Majeure Event are minimized. The Impacted Party shall resume the performance of its obligations as soon as reasonably practicable after the removal of the cause. In the event that the Impacted Party's failure or delay remains uncured for a period of 30 days following Notice given by it, the other party may thereafter terminate this Agreement upon Notice. The non-refundable retainer applies for all Force Majeure Events.

4.4 Failure to Perform Services
In the event I cannot or will not perform my obligations under our Agreement, I will:

  1. Immediately give Notice to you;
  2. Attempt to find another competent professional to take my place with your mutual agreement;
  3. If another competent professional is not available or you do not agree to transfer of obligations to said alternate professional, I will issue a refund or credit based on a reasonably accurate percentage of services rendered; and
  4. Excuse you of any further performance and/or payment obligations in our Agreement.

5. Copyright and Usage Rights

5.1 Copyright Ownership
I retain all copyright to all images created during your elopement. You hereby waive any claims for ownership, income, editorial control, and use of the images beyond what is explicitly granted in our agreement.

5.2 Personal Use License
The limited, personal photo release grants you and your agents, including family and friends, the right to reproduce the images provided for personal use only and does not allow the photos to be altered, sold, or published, including, but not limited to, entering into contests, or submitting to online blogs or publications, without my express written consent. 

5.3 Portfolio Rights
I reserve the right to use images from your elopement for my portfolio, social media, contests, marketing materials, and other professional purposes unless otherwise specified in our contract.

6. Risks and Liability

6.1 Adventure Activities
You assume and take on all risks associated with adventure elopements, elopement activities, and travel. I assume no risk or liability for failures on behalf of third parties or for any injuries or accidents that may occur during the elopement.

6.2 Safe Working Environment
I reserve the right to terminate coverage and leave the location if I experience inappropriate, threatening, hostile, or offensive behavior from anyone at the elopement, or if I feel my safety or equipment is in jeopardy.

6.3 Harassment Policy
I maintain a strict no-harassment policy and reserve the right to immediately terminate services without refund if any client or guest engages in harassing, abusive, or discriminatory behavior toward me or my assistants.

6.4 Limitation of Liability
My liability is limited to the amount paid for my services. I am not liable for any indirect, incidental, or consequential damages arising from my services or your use of my website.

7. Website Usage

7.1 Intellectual Property
All content on my website, including but not limited to text, graphics, logos, images, and software, is my property and is protected by copyright and other intellectual property laws.

7.2 Accuracy of Information
While I strive to provide accurate information on my website, I do not warrant that the information is complete, reliable, or error-free. I reserve the right to make changes to my website content at any time without notice.

7.3 External Links
My website may contain links to third-party websites. I am not responsible for the content or practices of these websites and do not endorse or make any representations about them.

8. Changes to Terms and Conditions
I reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to my website. Your continued use of my website or services after any changes indicates your acceptance of the modified Terms and Conditions.

9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

11. Severability
